Please read these Terms of Service ("Terms") carefully before using the is.ag website or any mobile applications, including HEX & GO (collectively, the "Services"), operated by ISAG, Inc. ("we", "us", or "our").

By accessing or using the Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Services.

1. Account Registration and Security

To access certain features of our Services, you may be required to create an account. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any breach of security or unauthorized use of your account.

2. Acceptable Use and Fair Play

Our Services, particularly our location-based games, rely on fair play and accurate real-world data. By using our Services, you strictly agree NOT to:

• Use GPS spoofing, location simulators, or any software that falsifies your real-world location.
• Falsify health or fitness data (e.g., artificially generating steps or calories).
• Use bots, macros, or automated scripts to interact with the Services.
• Harass, threaten, or physically endanger other players in the real world.
• Trespass on private property or enter dangerous/restricted areas while using our Services.

Violation of these Fair Play rules will result in immediate and permanent termination of your account without notice.

3. Real-World Interaction and Assumption of Risk

Our location-based applications require you to interact with the real world. You agree that your use of the Services is at your own risk. ISAG, Inc. is not responsible for any property damage, personal injury, or death that may occur while using our Services. Always remain aware of your surroundings, obey traffic laws, and respect local regulations.

4. Intellectual Property

The Services and their original content, features, and functionality (including but not limited to game lore, UI design, and source code) are and will remain the exclusive property of ISAG, Inc. and its licensors. The Services are protected by copyright, trademark, and other laws of both the Republic of Panama and foreign countries.

5. Virtual Goods and Purchases

Our Services may include virtual currencies or items ("Virtual Goods"). You obtain a limited, revocable, non-transferable license to use these Virtual Goods. Virtual Goods have no real-world monetary value and cannot be exchanged for fiat currency. All purchases of Virtual Goods are final and non-refundable.

6. Limitation of Liability

In no event shall ISAG, Inc., nor its directors, employees, partners, or agents, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Panama, without regard to its conflict of law provisions.
